Layoffs and other situations
Layoffs are treated like discharge for cause: wages due immediately unless a written personnel policy extends the deadline to the next regular payday or 15 days, whichever is first. Final pay may go through regular pay channels or by mail if the employee asks. If an employee is fired over alleged theft connected to the work, the employer may withhold the value of the theft only if the employee agrees in writing or the theft is reported to police within 7 business days; withheld wages become due if no charges are filed within 30 days (MCA 39-3-205(3)). Unused vacation and PTO
Earned vacation is wages and must be paid at separation. The Montana Department of Labor says use-it-or-lose-it policies are not permitted. Source: erd.dli.mt.gov↗ (opens in a new tab)
If the final paycheck is late
Late or unpaid wages are a misdemeanor, and the employer must also pay the employee a penalty of up to 110% of the unpaid wages, on top of the wages themselves. Source: mca.legmt.gov↗ (opens in a new tab)
The law and where to check

What federal law says
The federal Fair Labor Standards Act does not require employers to give a final paycheck immediately. The U.S. Department of Labor says an employee who has not received final pay by the regular payday for their last pay period can contact its Wage and Hour Division or the state labor department. Final paycheck checklist for Montana employers
A simple order of work, based on the rules above. It is not a legal checklist.
- Write down how the job ended: fired or let go, or the employee quit. If they quit, note whether and when they gave notice.
- Find the deadline for that situation in the table above.
- Add up all hours worked up to the last day, including any overtime.
- Check your written vacation or PTO policy and the vacation rule above.
- Add any commission or bonus that was earned, using the rules above.
- Pay on time by your usual method, or by mail if the rules above allow it and the employee asks.
- Keep a dated record of what you paid and when.
