This template is a free starting point, not legal advice. MadyHR.ai is not a law firm and cannot give legal advice. Employment law is different in every state, and some cities have their own rules. Laws also change. Before you use this template, check it against the laws where your employees work, and speak to an employment attorney or your state labor department if you are unsure. When to use this template

  • Shift-based or customer-facing teams
  • Managing repeated lateness fairly
  • Replacing informal, inconsistent rules

Tips before you use it

  • Never count protected absences against an employee — for example FMLA leave, state paid sick leave, jury duty, military service or a disability accommodation.
  • Apply the rules consistently to everyone.
  • Non-exempt employees must still be paid for all time actually worked, even if they clock in late.
Rules in your state may differ. Federal law sets the minimum. Your state — and sometimes your city or county — may add extra rules on this topic. Check with your state labor department before you use this template. Find your state labor office (U.S. Department of Labor)

Attendance and Punctuality Policy

Reliable attendance helps us serve customers and support each other. This policy explains what we expect and how to tell us when you cannot be at work on time.

Reporting an absence or lateness

  • Contact [Manager Name or Title] by [phone / text / app] at least [Number] hour(s) before your shift starts, or as soon as you can in an emergency.
  • Say when you expect to return.
  • A message to a co-worker is not enough.

No-call/no-show

Missing a scheduled shift without telling your manager is a serious matter. [Number] consecutive no-call/no-shows may be treated as a voluntary resignation, unless there was an emergency that prevented you from contacting us.

Repeated attendance problems

Repeated unexcused absences or lateness may lead to discipline, usually starting with a conversation and a verbal warning, then a written warning, and up to and including termination.

Protected absences

The following are never counted against you under this policy: leave protected by the Family and Medical Leave Act, paid sick leave under state or local law, military leave, jury duty, leave approved as a reasonable accommodation, and any other leave protected by law.

This policy is not a contract of employment and does not change the at-will nature of employment with [Company Name]. [Company Name] may change this policy at any time, and will apply it in line with federal, state and local law.

I have received and read this policy, and I understand it.

Frequently asked questions

Can I discipline an employee for being absent while on FMLA leave?

No. FMLA-protected absences cannot be counted against an employee under an attendance policy. The same applies to many state sick leave laws, military leave and absences that are a reasonable accommodation.

What is a no-call/no-show?

An absence where the employee does not report for a scheduled shift and does not tell their manager. Many policies treat repeated no-call/no-shows as job abandonment, but give the employee a chance to explain, in case of an emergency.
