This template is a free starting point, not legal advice. MadyHR.ai is not a law firm and cannot give legal advice. Employment law is different in every state, and some cities have their own rules. Laws also change. Before you use this template, check it against the laws where your employees work, and speak to an employment attorney or your state labor department if you are unsure. You use this template at your own risk, and MadyHR.ai accepts no responsibility for how it is used. When to use this template

  • Writing your first handbook
  • Checking an existing handbook for gaps
  • Growing past your first few employees

Tips before you use it

  • Keep an at-will statement and a clear disclaimer that the handbook is not a contract.
  • Add state-specific sections where your state requires them (for example paid sick leave or meal breaks).
  • Get a signed acknowledgment from every employee and keep it on file.
  • Review the handbook at least once a year — laws change.
  • Montana is not an at-will state after a probationary period — get the at-will wording reviewed if you employ anyone there.
Rules in your state may differ. Federal law sets the minimum. Your state — and sometimes your city or county — may add extra rules on this topic. Check with your state labor department before you use this template. Find your state labor office (U.S. Department of Labor)

Frequently asked questions

Is an employee handbook required by law in the US?

No federal law requires a handbook, but many laws require you to give employees certain information, and a handbook is the simplest way to do it. For example, employers covered by the FMLA must include FMLA information in a handbook if they have one.

Should a handbook be signed?

Yes. A signed acknowledgment shows the employee received the handbook and understands it is not a contract and that employment is at-will.
