This template is a free starting point, not legal advice. MadyHR.ai is not a law firm and cannot give legal advice. Employment law is different in every state, and some cities have their own rules. Laws also change. Before you use this template, check it against the laws where your employees work, and speak to an employment attorney or your state labor department if you are unsure. When to use this template

  • Setting up sick leave for the first time
  • Your state or city has passed a paid sick leave law
  • Separating sick leave from vacation

Tips before you use it

  • Check your state and city first — many paid sick leave laws set a minimum accrual rate and limit when you can ask for a doctor's note.
  • Employers with 50 or more employees for 20 or more workweeks (and all public employers) must also follow the Family and Medical Leave Act for eligible employees.
  • Keep any medical notes confidential and separate from the personnel file.
Rules in your state may differ. Federal law sets the minimum. Your state — and sometimes your city or county — may add extra rules on this topic. Check with your state labor department before you use this template. Find your state labor office (U.S. Department of Labor)

Frequently asked questions

Is paid sick leave required by federal law?

Not for most private employers. Some federal contractors must provide it, and many states and cities have their own paid sick leave laws. The U.S. Department of Labor sick leave page explains the federal position.

Can I ask for a doctor's note?

Often yes, but many state and local sick leave laws limit when you can require one — for example only after several consecutive days. Check your local law before adding a doctor's note rule.
